Consumer Health Data Privacy Notice

This notice applies to the Atlas Metabolic consumer wellness features — the member community, milestone tracking, and AI wellness coaching. It explains what Consumer Health Data those features collect, what we do with it, and how to withdraw your consent. It is written to meet the Washington My Health My Data Act and the similar consumer-health-privacy laws in Nevada and Connecticut.
The Atlas consumer features are wellness and education tools. They are not a medical service. They do not diagnose, treat, or prescribe, they are not a medical record, and they are not a substitute for care from a licensed clinician.
Atlas deliberately does not collect protected health information through these features. There is no clinician write-path into them, no prescription data, and no import from any electronic health record. If you are a patient of a clinic that licenses Atlas software, your medical record sits with that clinic, is governed by HIPAA, and is covered by that clinic's own notices — not this one.
What Consumer Health Data We Collect
"Consumer Health Data" means information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status. In these features, that means only what you choose to enter:
- Wellness milestones you log — for example a weight-change milestone, a streak, or a goal you mark as reached.
- Community posts and reactions you write — anything you type into the member community, which may describe how you are feeling or how your wellness journey is going.
- AI coaching conversations — the messages you send to the AI wellness coach and the replies it gives you.
- Basic account information that connects the above to you, such as your first name or display name and the clinic whose programme you are enrolled in.
You are never required to enter any of it. You can use the programme without posting in the community, without logging a milestone, and without using the AI coach.
How We Use It
- To show you your own progress and history.
- To display your community posts to other members of your community, as you intend when you post.
- To let the AI wellness coach respond with relevant, non-clinical encouragement and education.
- To review content against our community rules — including automated screening that holds posts for human review when they may contain unsafe or non-compliant claims.
- To keep the service working, secure, and free of abuse.
What We Do Not Do With It
- We do not sell your Consumer Health Data. Not for money, and not for anything else of value. Under the My Health My Data Act a sale would require your separate, specific written authorisation, and we do not ask for one because we do not do it.
- We do not use it for targeted advertising. The advertising pixels described in our Privacy Policy run on our public marketing website. They are not used to target you based on anything you log, post, or say to the coach.
- We do not share it with your employer or your insurer.
- We do not use geofencing around any health facility.
Who Can See It

Our service providers act on our instructions and may not use your Consumer Health Data for their own purposes.
Your Rights
Under the Washington My Health My Data Act, Nevada SB 370, the Connecticut Data Privacy Act, and comparable laws elsewhere, you have the right to:
- Confirm whether we hold Consumer Health Data about you, and access it.
- Get a list of the third parties with whom we have shared it, and how to contact them.
- Delete it, including from our backups and archived systems, subject to the narrow exceptions the law allows.
- Withdraw your consent to its collection and to its sharing, at any time.
- Appeal if we refuse a request. We will explain the refusal in writing and tell you how to escalate, including to your state Attorney General.
- Not be discriminated against for exercising any of these rights. Your access to the programme will not be reduced because you asked.
We respond within 45 days, and will tell you if we need a permitted extension.
Withdrawal of Consent
You may withdraw your consent at any time, and you do not have to give a reason.
Email support@atlasmetabolic.com with the subject line "Withdrawal of Consent" and the email address or display name on your account.
When you withdraw consent we stop collecting Consumer Health Data through these features, and we stop any sharing of it. Withdrawal is not retroactive — it does not undo processing that already lawfully happened — so if you also want what we already hold to be erased, say "and delete my data" in the same email and we will treat it as a deletion request as well.
Withdrawing consent may mean parts of the wellness features stop working for you — the community feed and the AI coach in particular. It will not affect your care from your clinic, and it will not affect any treatment you are receiving.
Security and Retention
Access to Consumer Health Data is restricted to the people and systems that need it, and it is encrypted in transit. We keep it while your account is active and delete it on request as described above.
No system is perfectly secure. Please do not post anything in a community feed that you would not want other members to read.
Children
These features are intended for adults. We do not knowingly collect Consumer Health Data from anyone under 18. If you believe a minor has an account, tell us and we will remove it.
Changes To This Notice
If we change this notice we will update the date at the top of this page. Where the law requires your consent for a new use of Consumer Health Data, we will ask you before that use begins — not afterwards.

Washington residents who are not satisfied with our response may complain to the Washington State Attorney General at atg.wa.gov/file-complaint.
